Terms of Use

These Terms govern access to the Heard app, website, beta program, and related services operated by Tyler Sharp.

Effective date: August 16, 2026

By accessing or using Heard, you agree to these Terms. If you do not agree, do not use Heard. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms where required by law.

1. Operator and contact

Heard is owned and operated by Tyler Sharp, 8649 McHugh Street, Windsor, Ontario, Canada. Contact: heardappsupport@gmail.com or 548-996-7612.

2. Eligibility

You must be at least 13 years old to use Heard. Users aged 13 through the age of majority may use Heard only with permission from a parent or legal guardian where required. You may not use Heard if applicable law prohibits you from receiving the service.

3. Beta and pre-release service

Heard is currently in exclusive beta. Features, functionality, availability, recommendations, data structures, and app appearance may change before public release. Beta features may be incomplete, unavailable, or contain errors. You should keep independent copies of information that is important to you.

4. Accounts and security

You agree to provide accurate information, maintain the security of your device and account, and promptly report suspected unauthorized access. You are responsible for activity occurring through your account unless prohibited by law. Heard may require age or identity verification where reasonably necessary for safety, privacy, or legal compliance.

5. Acceptable use

You may not:

6. User content

You retain ownership of reviews, photographs, messages, rankings, and other content you create. You grant Heard a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably needed to operate, secure, improve, and present Heard according to your selected sharing settings. The license ends when the content is deleted, except for copies reasonably retained in backups, legal records, or content already shared by other users where deletion is not technically or legally possible.

You represent that you have the rights and permissions needed to submit your content. Heard may remove, restrict, preserve, or disclose content when reasonably necessary to enforce these Terms, protect users, investigate abuse, or comply with law.

7. Social features and communications

Critics, group chats, polls, invitations, shared recommendations, and plans involve other users. Recipients may save or redistribute content they receive. Do not share confidential, sensitive, or health information in messages unless you accept that risk. Heard cannot control another user’s conduct outside the service.

8. Restaurant, map, menu, and web information

Hours, menus, prices, ingredients, allergens, crowd levels, reservations, ratings, directions, and venue details may come from users, public web content, restaurants, Apple Maps, or other sources and may be incomplete, delayed, or incorrect. Confirm time-sensitive or safety-critical details directly with the venue. Third-party websites and content accessed through WebKit are governed by their own terms and policies.

9. Recommendations and Heard Says

Heard Says and Heard Match outputs are automated recommendations based on available preferences, activity, location, Critic signals, and venue information. They are suggestions, not guarantees of quality, safety, suitability, availability, or outcome. Use your own judgment before visiting a venue, making a purchase, or acting on a recommendation.

10. Nutrition, allergens, and health features

Calories, macronutrients, ingredients, allergen flags, dietary compatibility, and receipt-derived information are estimates and may be inaccurate. Heard is not a medical service and does not provide medical, nutritional, allergy, diagnosis, or treatment advice. Users with allergies, medical conditions, or dietary requirements must verify ingredients and preparation practices directly with the restaurant and consult a qualified professional when appropriate.

Apple Health integration is optional. You control HealthKit authorization through Apple’s system interface. Heard must not be used for emergencies or medical decisions.

11. Split the Bill

Receipt scanning and bill calculations are convenience tools. Users are responsible for confirming recognized items, taxes, fees, tips, assignments, and final amounts before paying or requesting payment. Heard does not process payments unless a future feature expressly says otherwise.

12. Apple and third-party services

Use of Heard may involve Apple HealthKit, CloudKit/iCloud, Siri, Maps, WebKit, Supabase, website hosting providers, and Apple’s standard terms. Apple is not responsible for Heard’s content, support, or operation except as required by Apple’s applicable agreements. Third-party services may change or become unavailable.

13. Heard intellectual property

Heard’s software, name, logo, branding, design, text, and original materials are owned by Tyler Sharp or licensed to Heard and are protected by applicable laws. These Terms do not transfer ownership. You may not use Heard’s branding in a way that suggests sponsorship or endorsement without written permission.

14. Availability, modification, and termination

Heard may modify, suspend, restrict, or discontinue any part of the service. Heard may suspend or terminate access for a material violation of these Terms, security risk, legal requirement, or harm to users or the service. Where reasonable, Heard will provide notice and an opportunity to appeal. You may stop using Heard and request account deletion at any time.

15. Disclaimers

To the maximum extent permitted by law, Heard is provided on an “as is” and “as available” basis without warranties of uninterrupted operation, accuracy, merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

16. Limitation of liability

To the maximum extent permitted by law, Tyler Sharp and Heard will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, personal decisions based on recommendations, restaurant conduct, user conduct, or third-party services. Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. These limitations do not apply where prohibited or to liability that cannot legally be limited.

17. Indemnity

To the extent permitted by law, you agree to indemnify Tyler Sharp and Heard from third-party claims arising from your unlawful use of Heard, your content, or your material violation of these Terms. This obligation does not apply to the extent a claim results from Heard’s own unlawful conduct.

18. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Courts located in Windsor, Ontario will have jurisdiction, unless mandatory consumer law gives you the right to bring a claim elsewhere. U.S. and Canadian consumers retain non-waivable rights provided by the laws that apply to them.

19. Changes

Heard may update these Terms as the beta, services, or laws change. Material changes will be identified by an updated effective date and, when required, additional notice or consent. Continued use after an effective update constitutes acceptance where permitted by law.
